Compliance Challenge: Digital Services Act (DSA) Compliance, Transparency Reporting, Risk Management

The Challenge
SparkLoop operates a platform connecting brands with micro-influencers across Europe. Their business model relies heavily on algorithmic recommendations and targeted advertising. The EU’s Digital Services Act (DSA) , applicable to all online platforms serving EU users, posed an existential compliance threat.
Key difficulties:
New DSA Obligations:

SparkLoop was classified as an “online platform” under the DSA, requiring specific transparency reports, user-friendly terms, and annual risk assessments.

Lack of Internal Expertise:

As a lean tech company, SparkLoop had no dedicated legal or compliance team. The founder-CEO was personally managing legal risk.

Algorithmic Transparency:
The DSA requires platforms to explain why users see certain content. SparkLoop had no documentation on how their recommendation engine operated from a compliance perspective.
Illegal Content Reporting:
No formal mechanism existed for users to report illegal content or for SparkLoop to respond within the DSA’s strict timelines.
Budget Constraints:

With runway focused on product development, engaging a top-tier international law firm (estimated €60k–€100k) was impossible.

The DigiJao Solution

Phase 1: DSA Classification & Gap Analysis (Days 1–5)

Worked with SparkLoop engineers to document key parameters of their recommendation algorithm in non-technical, user-friendly language.

Published a dedicated "DSA Information Hub" on SparkLoop’s website, meeting transparency obligations.

Post-Engagement: Ongoing DSA Compliance Monitoring

Transitioned SparkLoop to DigiJao’s continuous compliance subscription, including quarterly risk assessment updates and real-time DSA regulatory monitoring.
